General Terms and Conditions of Sale

The present General Terms and Conditions of Sale (“GTC”) govern the offer and sale of products on the sales section of the website www.cazabat.paris ("Site").
The products sold on the Site ("Products") are offered by CAZABAT, whose registered office is located at 2 rue Alfred de Vigny, 75008 Paris, France, email: [email protected].

The client acknowledges having read and accepted these general terms and conditions of sale prior to placing their order. Validation of the order implies acceptance of these terms and conditions.

Article 1 - Principles

The present general terms and conditions represent the entirety of the obligations between the parties. By placing an order, the buyer is considered to accept these terms unconditionally.
These GTC apply exclusively and take precedence over any other terms, including those applicable to in-store sales or other distribution and marketing channels.
They are accessible on the CAZABAT website and will prevail, where applicable, over any other version or conflicting document.

Article 2 - Scope

The purpose of these terms and conditions is to define the rights and obligations of the parties in the context of the online sale of goods offered by the seller to the buyer via the CAZABAT website.
These conditions apply exclusively to purchases made on the CAZABAT website.

Article 3 - Pre-contractual Information

The buyer acknowledges having received clear and understandable communication, prior to placing their order and concluding the contract, of the present terms and conditions and the information listed in Article L. 221-5 of the French Consumer Code, including:

- Essential characteristics of the product
- Product price and/or the price calculation method
- Additional costs, such as delivery or postage fees, if applicable
- Delivery timelines or deadlines
- Information about the seller, including legal guarantees and conditions for their application, and any applicable contractual terms

Article 4 - Orders

The buyer can place orders online via the catalog and the form provided, for any available product.

- The buyer must accept the GTC by clicking where indicated.
- They must provide their delivery address, select a delivery method, and confirm their payment method.
- The sale is finalized once the seller confirms the order via email and receives the full payment.
- The seller reserves the right to block orders in cases such as non-payment or incorrect buyer information.

Article 5 - Electronic Signature

Providing the credit card number online and final order validation constitute proof of the buyer's consent, obligating payment and acceptance of all order-related operations.

Article 6 - Order Confirmation

The seller will send the buyer an email confirming the order.

Article 7 - Proof of Transaction

Digital records kept securely by the seller serve as proof of communications, orders, and payments between the parties.

Article 8 - Product Information

Products are listed on the seller's website and described as accurately as possible. Images are for illustrative purposes only and may differ slightly from the actual product.

Article 9 - Prices

- Prices are displayed in euros and include VAT.
- Delivery fees are charged separately and specified before order confirmation.
- The seller reserves the right to modify prices at any time but will apply the rates valid at the time of order placement.

Article 10 - Payment Methods

Orders require immediate payment. Available payment options include Visa, MasterCard, American Express, PayPal, Apple Pay, and Shop Pay.

Article 11 - Product Availability, Refunds, and Contract Termination

- Standard free shipping via DHL: 2-6 business days. Express options: 1-2 days for Europe and the UK.
- In cases of non-delivery within the agreed timeframe, the buyer may terminate the contract and request a refund.

Article 12 - Delivery

- Products are delivered to the address specified by the buyer.

- If the package is damaged, the buyer should refuse the delivery and notify the seller.

Article 13 - Errors in Delivery

The buyer must report delivery errors within one business day.

Article 14 - Legal Warranty of Conformity

Products are covered for defects for two years from delivery. Buyers can request repair, replacement, or refunds if defects are found.

Article 15 - Right of Withdrawal

- Buyers have 14 days from delivery to return products for a refund or exchange.
- Returned products must be in their original condition and packaging.

Article 16 - Force Majeure

The seller is not liable for delays caused by events beyond their control, such as natural disasters or strikes.

Article 17 - Intellectual Property

The website content is the exclusive property of the seller. Any unauthorized use may result in legal action.

Article 18 - Personal Data

Personal data is collected to process orders. Buyers have the right to access, modify, and delete their information.

Article 19 - Governing Law

These GTC are governed by French law, and disputes will be settled in French courts.
